The Romanian legislation does not impose any restriction on the purchase of apartments and their associated quota of land by European Union and EEA citizens.
Citizens from non EU or EEA countries are permitted to purchase an apartment and the right of superficies, which lasts for as long as the building exists. Citizens from certain foreign countries may enjoy more permissive property ownership conditions, depending on bilateral treaties that Romania has with specific countries.
According to the fiscal authorities, the law does not restrict foreign citizens’ rights to benefit from the 5% VAT rate when purchasing an apartment. The same criteria apply to foreign citizens as to Romanian citizens regarding benefiting from the use of the reduced VAT rate.
